Refund policy
Modifications, Cancellations, Exchanges, Returns and Abuse
1. Binding Nature of the Order
Any order placed with Mood Collection SA is firm, final and legally binding upon confirmation, subject exclusively to the mandatory provisions of Swiss law.
By placing an order, the customer irrevocably accepts the sales contract, these General Terms and Conditions, and any specific conditions applicable to the relevant product.
2. Order Modifications
Any request to modify an order (including but not limited to article, size, delivery address, options or quantities) must be expressly submitted in writing within a strict and mandatory period of twelve (12) hours following order confirmation.
The customer receives an order confirmation by email. It is the customer’s responsibility to verify its accuracy (size, product details, number of items, color, selected material, etc.). In case of doubt or error concerning one or more ordered items, the customer must immediately contact Mood.
Such modification is strictly possible only provided that:
- preparation,
- production,
- personalization,
- or shipment
has not yet begun.
After this period, or once any of the above processes has commenced, no modification will be accepted, without exception and without tolerance.
3. Cancellations and Exchanges
Order cancellations and exchanges are formally excluded, except in cases strictly required by the mandatory provisions of applicable Swiss law.
These provisions are limited exclusively to the following situations:
- proven material or manufacturing defect existing at the time of delivery (Art. 197 et seq. Swiss Code of Obligations),
- manifest non-conformity of the product with the contract,
- incorrect delivery attributable to Mood Collection SA.
Before completing payment, the customer is responsible for verifying that the total amount corresponds to their order, including the application of any promotional codes and any fees or taxes related to international deliveries. No refund or cancellation will be granted in case of failure to apply a promotional code.
Outside of these strictly defined legal situations, no right of cancellation, exchange, refund or credit is recognized, including but not limited to cases of:
- change of mind,
- ordering error attributable to the customer,
- personal preference,
- subjective appreciation of the product.
4. Single Exception – Size Exchange (First Ring Only)
As an exceptional, one-time and non-renewable gesture, a size exchange may be granted exclusively for the first Mood ring purchased by a customer (whether as a gift or self-purchase), if the originally ordered size does not fit.
This exchange is cumulatively subject to the following conditions:
- the ring has never been worn,
- the item is returned in strictly new, complete and undamaged condition,
- the request concerns size adjustment only, excluding any change of model, collection or finish,
- the request is made within the deadlines and according to the procedure defined by Mood Collection SA.
No other exchange will be granted, even on a goodwill basis.
5. Custom-Made and Personalized Products
Custom-made, personalized or made-to-order products (including but not limited to engravings, specific sizes, bicolor items, special orders, limited editions or fine jewelry pieces) are strictly non-modifiable, non-exchangeable, non-cancellable and non-refundable once the order has been confirmed, without exception.
6. Unauthorized Returns
Any return of merchandise made without prior written approval or outside the cases provided for in these General Terms and Conditions shall be considered unauthorized.
Such return:
- gives no right to refund, exchange or credit,
- the merchandise will be held at the customer’s disposal for a limited period,
- reshipping or storage fees may be charged.
7. Abuse and Bad Faith
Any abusive behavior, including but not limited to:
- repeated or unjustified returns,
- attempts to circumvent the General Terms and Conditions,
- inaccurate declarations,
- conduct contrary to the principle of good faith (Art. 2 Swiss Civil Code),
authorizes Mood Collection SA to:
- refuse to process future requests,
- suspend or prohibit any subsequent orders,
- unilaterally terminate the contractual relationship,without compensation or prior notice.
8. Express Reservation
These clauses are drafted in compliance with the Swiss Code of Obligations and are not intended to exclude any mandatory rights of the customer that cannot legally be waived.
